£22,500 fine completely quashed!
Yet another Council not acting as required by the law.
Landlord Licensing & Defence was able to get the fine quashed for our Landlord client after our forensic analysis of the case detail and data proved the council had issued the fine before they had completed their investigation. The law is very, very clear, and we were able to prove that the council did not have evidence to the legally required standard of “beyond reasonable doubt”.vThe council had issued the fine illegally (as so many councils do) without having evidence to the legally required standard. The council then continued to investigate because they did not have the evidence, and as they kept asking for more and more information from the landlord in their attempts to get the landlord to self incriminate.
Fortunately for the landlord, as soon as they received the Notice of Intention to Impose a Financial Penalty they appointed Landlord Licensing & Defence as expert representatives and we were immediately able to protect the landlord from the council’s illegal attempts to post-justify their illegal fine and ultimately we left the council with no alternative but to quash it completely due to proving, and calling out, their legal actions. It was really clear that the council themselves were not complying with the law.
This is the type of illegality we find and fight on a daily basis from councils across the land for our landlord clients. If you need help, you know where to come.hashtag#landlordshashtag#propertyhashtag#enforcementFree Diagnosis Call available about any issue that you may have – book one below any time you need help or think the council is dealing illegally or unfairly with you.
